EB-5 OVERVIEW
  • United States Congress created the Employment-Based Fifth (EB-5) Immigration Investor green card program in 1990 for qualified foreigners seeking to invest in a business that will benefit the U.S. economy and create or save at least 10 full-time jobs for U.S. workers.

  • EB-5 Immigrant Investor green card eligibility essentially depends on investing the required capital from legal sources and creating 10 jobs for U.S. workers. If the investment is in a Targeted Employment Area (“TEA”), which is an area with an unemployment rate of 1.5 times the national average, or a rural area, the required investment amount is $500,000. Otherwise, the required amount is $1,000,000.

  • There are no restrictions regarding age, education, business experience or language. EB-5 immigrant investor and their family may live and work where ever they please, regardless of the location of the investment.

  • Permanent Resident status based on EB-5 eligibility is available to investors, their spouses and unmarried children under 21 years of age.

  • Of the 10,000 EB-5 green cards available each year, 3,000 are reserved for immigrant investors who invest through a Regional Center. The U.S. Citizenship and Immigration Services (“USCIS”), which administers the EB-5 program, estimates that 90% of EB-5 visas are based on regional center investment.
